Privacy Policy

At Gooday Corporation Pty Ltd (furthermore referred to as “Gooday”) and our Gooday subsidiaries (“Gooday”), we respect your privacy and are committed to maintaining your trust. This privacy policy (“Privacy Policy”) applies to visitors of our Gooday sites, apps, software as a service, and users of the Gooday Services.

This Privacy Policy describes our practices and your rights in connection with information that we collect, use, or disclose through:

  • Our consumer-facing mobile application (“Gooday App”);

  • Our consumer-facing websites, currently located at https://www.gooday.com.au (the “Gooday Website(s)”);

  • Our online business and consumer management software products (“Software as a Service” or “Services” or “Service”);

  • Our social media pages;

  • Our applications through which Gooday makes the Software as Service available, including the Gooday business app and the Gooday branded mobile app (collectively the “App”);

  • HTML-formatted email messages that we send to you that link to this Privacy Policy;

  • And any other products and services offered through any other venues, websites, and mobile applications that direct you to this Privacy Policy. Collectively the “Gooday Services”.

When you access or use the Gooday Services, you agree to the terms and conditions of this Privacy Policy and that the information contained in this Privacy Policy serves as notice at or before the point of collection for all information collected as described below.

 

1. Defined Terms

The following terms will have the meanings indicated below. Please refer to our Terms and Conditions for any capitalized terms that are not defined in this Privacy Policy.

  • “End User” means any individual who interacts with the Gooday Services, including users of our mobile applications such as the Gooday App, and individuals who book appointments, purchase services, and otherwise interact with Businesses and Social Clubs through the Gooday Services.

  • “Other Information” is any information that does not reveal your specific identity or does not relate to an individual, such as usage data not linked to any unique identifiers.

  • “Personal Information” means data that relates to or about an identified or identifiable natural person or, where applicable, household as defined under relevant law. This may include information such as name, postal address, telephone number, email address, or unique online identifiers.

  • “Business/Social Club” refers to any entity that creates an account to access or use our Software Service, including any staff, employees, consultants, advisors, or independent contractors accessing the Gooday Services on the entity’s behalf.

  • “Trojan Horsing” refers to the unauthorized use of a Gooday account to harvest user data, poach community members for external platforms, or misrepresent the nature of an event or business to bypass Gooday’s platform fee structures.

 

2. Categories of Personal Information

While the Personal Information we collect varies depending upon the nature of the Gooday Services provided or used and our interactions with individuals, Personal Information we may collect or obtain includes:

  • Contact details (e.g., name, address, email, telephone number, which may include third-party emergency contact information);

  • Personal details (e.g., date of birth, education, nationality);

  • Calendar data, including event details, availability information, and calendar metadata, when you choose to connect your Google account;

  • Financial and transaction data (e.g., purchase history, account information, shipping and billing information, including credit card information etc.). This data is specifically required to facilitate the $2.00 AUD per-person booking fee and applicable commissions;

  • Health and fitness tracker data collected from heart rate monitors and other performance monitoring activities;

  • Other Gooday Services related data (e.g., customer requests, statistics, etc.);

  • Geolocation data with your permission (e.g., geolocation data sent via a mobile device);

  • Images you upload to the Gooday Services;

  • Online identifiers (e.g., IP address, Device IDs, etc.); and

  • Cookie-related data.

To the extent that we are in possession of de-identified information, we commit to maintaining and using de-identified information without attempting to re-identify the information.

 

3. How We Collect Information

Through the Gooday Services We collect information about you whenever you use the Gooday Services, for example:

  • End Users: When you create an account on the Gooday App or through the Gooday Consumer Site(s), we may ask for Personal Information such as your name, email and postal address, social media account ID, and Other Information you may provide with your account.

  • End User Interactions: If you are an End User interacting with the Gooday Services through a Business or Social Club, we also collect Personal Information that you provide to the Gooday Services when you initiate a transaction or otherwise engage with that entity, such as to book an appointment, make a purchase, or respond to a marketing campaign.

  • Businesses and Social Clubs: When you sign up for our Software as a Service, we ask for your company name, address, phone number, email, credit card information, business identification number, and other information about your business, as well as names and email addresses of authorized individuals on your account.

Location Services: We and our service providers collect information about your location when you use or access Gooday Services. Those sources include:

  • Data from your device through settings you activate;

  • IP address. We collect and use this location-related data in order to:

  • Provide you with services you have purchased or requested;

  • Deliver content and marketing that is relevant to you based upon your location;

  • Protect against abuse, fraud, or misuse of services (including Trojan Horsing).

From other sources: We may receive information about you from public databases, strategic and joint marketing partners, and social media platforms. If you choose to connect your Google account, we collect Google Calendar data through Google’s OAuth API. This includes read and write access only to the specific calendar data you authorize. We do not access any other Google data.

 

4. How Personal Information May Be Used

We use your Personal Information for legitimate business purposes, including:

  • Functionality: To create and administer accounts, fulfill and record transactions, and manage the pricing model (including the $2.00 per-person booking fee and the 5%–7.5% experience/pre-paid commissions).

  • Marketing Support: Gooday is committed to supporting all businesses and clubs. If a social club provides material regarding an upcoming event featured exclusively on Gooday, we will post and repost the event across all of our social channels to support maximum attendance.

  • Security & Trojan Horsing: For fraud and security monitoring, specifically to detect accounts suspected of “Trojan Horsing.” Gooday reserves the right to remove any account that we suspect is fraudulent or fake without being required to provide an explanation or written confirmation.

  • Technical Issues: To troubleshoot and improve the Services. However, Gooday will not be liable for any technical issues that occur between private and public events.

 

5. What and How Personal Information May Be Disclosed

5.1 Disclosed for a business purpose: We may disclose Contact details, Financial data, Geolocation, and Online identifiers to our affiliates and integrated partners (e.g., Stripe, Sendgrid, Twilio).

5.2 To Businesses and Social Clubs (The Liability Shift): If you are an End User, we disclose your Personal Information to the Business or Social Club you are interacting with.

  • Crucial Notice: If any business on Gooday has access to a customer’s personal data through our app, it is the sole responsibility of that Business and the Customer to abide by all Australian privacy laws in terms of the use of the customer data. Gooday will not be liable for any misuse of their data.

5.3 Corporate Transactions: In the event of any reorganization, merger, or sale, we may transfer your Personal Information to the acquiring entity.

 

5.4 Cross-Border Data Transfers. As we utilize sub-processors such as Stripe, Sendgrid, and Twilio, your Personal Information may be transferred to, stored, or processed in countries outside of Australia, including the United States. By using the Gooday Services, you consent to the transfer of your information to these overseas recipients. We take reasonable steps to ensure that these third parties adhere to data protection standards similar to those in Australia.

5.5 Content Licence and Use of Publicly Available Images.

User‑Uploaded Content When you upload, submit, post, or otherwise provide photos, videos, event materials, descriptions, or other content (“User Content”) to the Gooday Services, you grant Gooday a worldwide, royalty‑free, non‑exclusive, transferable, sub‑licensable, and irrevocable licence to use, reproduce, modify, adapt, publish, translate, distribute, publicly perform, publicly display, and create derivative works from such User Content for the purposes of:

  • operating and improving the Gooday Services;

  • promoting events hosted on Gooday;

  • marketing Gooday, including across social media, websites, advertising, and partner channels;

  • supporting Businesses and Social Clubs using the platform.

You represent and warrant that you have all rights necessary to grant this licence.

 

6. Refunds and Cancellations

6.1 Refund Autonomy: If a person would like a refund on services booked via Gooday, it is strictly up to the Business and the Consumer to figure out a solution. If a refund is required, that will come down to the Business. Gooday will not be responsible for handling the payment. 6.2 Retention of Fees: Gooday will not refund its commission, platform fees, or Stripe fees. All fees paid to Gooday remain final. 6.3 Enforcement: If a business has cancellation fees and clearly states their policy, it is up to the Business to enforce their own cancellation and any other policies. Gooday does not enforce venue-specific protocols.

 

7. Privacy Rights regarding your Personal Information

  • Right to Access/Portability: You may request a copy of your Personal Information in a usable format.

  • Right to Deletion: You may request deletion of your Personal Information, subject to record-keeping exemptions.

  • Right to Correct/Rectify: You may rectify any incorrect Personal Information.

  • Right to Object/Restrict: You may object to specific uses of your Personal Information. To submit a request, contact us at info@gooday.com.au with the subject line "Data Subject Request".

 

8. Your Choices

  • Marketing: You may opt-out from receiving electronic marketing communications via your account settings or unsubscribe prompts.

  • Third Parties: We only share your Personal Information with unaffiliated third parties for their marketing when you have provided explicit consent.

  • Calendar Revocation: You may revoke Gooday’s access to your Google Calendar at any time through your Google Account settings.

 

9. Data Retention & Termination

9.1 Retention Criteria: We retain Personal Information for as long as needed to fulfill the purposes for which it was obtained and to comply with legal obligations. 

9.2 Rights on Termination (The 7-Day Rule): Upon termination of your account, your rights to the Services cease. Gooday will retain Your Data for seven (7) days for export purposes. After this 7-day period, Gooday may delete Your Data without further notice. (This replaces all previous 30-day data retention provisions).

 

10. Security

The security of Personal Information is a high priority. We use industry-standard technology (SSL) and safeguards for Cardholder Data. However, no data transmission can be guaranteed 100% secure.

 

11. Use by Minors

Gooday Services are not directed at children under 13. If you are under 18, you may ask us to remove content you have posted by contacting info@gooday.com.au.

 

12. Technical Issues & Real-World Liability

12.1 Platform Performance: Gooday will not be liable for any technical issues that occur between private and public event listings. 12.2 Event Incidents: Gooday will not be liable for any incidents, injuries, or disputes that occur during an event hosted by the public or a Business. Users host and attend events at their own risk.

 

20. Calendar Data Access and Use

Gooday integrates with Outlook and Google Calendar to provide scheduling, availability insights, and event management features. When you choose to connect your Google account, Gooday may request permission to access certain Google Calendar data. This access is always optional and requires your explicit consent through Google’s OAuth consent screen.

Types of Google Calendar Data We Access Depending on the permissions you grant, Gooday may access:

  • Calendar lists associated with your Google account;

  • Event details, including event titles, times, locations, attendee lists, and availability;

  • Calendar metadata such as time zones and calendar settings.

If you grant write permissions, Gooday may also:

  • Create new events on your behalf;

  • Edit events that you explicitly choose to modify;

  • Delete events that you explicitly choose to remove.

Gooday does not access or store the content of emails, contacts, Google Drive files, or any other Google data outside of Calendar.

How We Use Google Calendar Data: Gooday uses your Google Calendar data solely to:

  • Display your availability within the Gooday App;

  • Suggest optimal times for plans and events;

  • Allow you to create, edit, or delete events when you choose to do so;

  • Sync Gooday‑created events to your Google Calendar;

  • Help you manage scheduling conflicts;

  • Improve the accuracy of time‑alignment features between you and your friends;

  • Help participating businesses and clubs using Gooday manage scheduling and attendance.

Gooday does not use Google Calendar data for:

  • Advertising;

  • Marketing;

  • Profiling;

  • Selling or sharing with third parties;

  • Any purpose unrelated to scheduling functionality.

How We Store and Protect Google Calendar Data:

  • Gooday stores only the minimum data required to provide the service. In most cases, Gooday processes your calendar data in real time and does not permanently store event details unless necessary for core functionality (e.g., syncing Gooday‑created events).

  • Any stored data is encrypted in transit and at rest using industry‑standard security practices.

  • Gooday does not store your Google password. Authentication is handled exclusively through Google’s OAuth system.

 

21. Changes to This Privacy Policy

Gooday may make changes to this Privacy Policy from time to time. Any changes we make will become effective when we post a modified version to https://www.gooday.com.au. Continued use of the Services after any changes constitutes acceptance of the new terms.

If you wish to make a complaint about a breach of the Australian Privacy Principles, please contact us with the details of your complaint. We will investigate and respond within a reasonable timeframe. If you are not satisfied with our response, you may refer your complaint to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.
